Terms of Service for The Pushups App

Agreement to Terms

By downloading, installing, or using The Pushups App ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

The Pushups App is a fitness tracking application that allows you to:

  • Track your daily pushup activities
  • Set and monitor personal fitness goals
  • View your progress and achievements
  • Participate in community leaderboards and goals
  • Receive workout reminders via push notifications

User Accounts

Account Creation

To use certain features of the App, you must create an account. When creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activities under your account

Account Termination

You may delete your account at any time through the App's Settings. We reserve the right to suspend or terminate accounts that violate these Terms.

User Conduct

When using the App, you agree not to:

  • Use the App for any unlawful purpose
  • Impersonate any person or entity
  • Interfere with or disrupt the App or servers
  • Attempt to gain unauthorized access to any part of the App
  • Use automated systems to access the App without permission
  • Post inappropriate or offensive content (usernames, profile pictures)
  • Manipulate leaderboards through fraudulent activity

Intellectual Property

The App, including its design, features, and content, is owned by us and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer or attempt to extract source code
  • Use our trademarks without permission

User Content

Your Content

You retain ownership of content you submit (such as profile pictures). By submitting content, you grant us a non-exclusive, royalty-free license to use, display, and store that content for the purpose of providing the App's services.

Content Standards

You agree that any content you submit will not:

  • Violate any laws
  • Infringe on others' rights
  • Contain harmful or offensive material

We reserve the right to remove any content that violates these Terms.

Health Disclaimer

The Pushups App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

  • Consult a healthcare professional before starting any exercise program
  • The App does not provide medical advice
  • You are solely responsible for your physical health and safety during exercise
  • Stop exercising immediately if you experience pain, dizziness, or discomfort

We are not liable for any injuries or health issues that may result from using the App or following its suggestions.

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of content

We do not warrant that:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data, profits, or goodwill
  • Personal injury or property damage
  • Any damages arising from your use or inability to use the App

Our total liability for any claims arising from these Terms or the App shall not exceed the amount you paid for the App (if any) in the past 12 months.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

Your continued use of the App after changes constitutes acceptance of the new Terms.

Dispute Resolution

Any disputes arising from these Terms or the App shall be resolved through:

  1. Informal Resolution: Contact us first to attempt to resolve the dispute informally
  2. Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration

You agree to waive any right to a jury trial or participation in a class action.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
